Phone etiquette is very important, as is the privacy of phone users. For instance, if you were to mistakenly dial the wrong number, you would apologize to the call recipient for disturbing them. Moreover, only in rare exceptions would you make a personal phone call very early in the morning or extremely late at night. Thus, you may be wondering why telemarketers seem to be able to call you at whatever time they please. Shouldn’t there be laws against this? Don’t they have business hours they must abide by? The answer to both of these questions is “Yes”.

Although it may feel likr a phone solicitor can call you at any time of the day or night, the reality is there is only a 13 hour time frame in which they are permitted to call you, and it exists from 8 am to 9 pm. Therefore, if you receive calls from any telemarketer, regardless if they are legally permitted to contact you or not, before 8 in the morning and after 9 in the evening this is against the law, and gives you grounds to file a complaint.

What should you do if you receive a call from a solicitor during non-call hours? Simply complete the following steps:

Step 1 – If the telemarketer does not provide their name and the name of the company on whose behalf they are calling after delivering their initial greeting (this is something they must legally do), ask them for this information, as well other information such as a phone number you can call back, which is very important if you don’t have caller ID.

Step 2 – Ask the caller to place your number on their company’s internal do-not-call-list.

Step 3 – Inform the solicitor that they have violated the guidelines stipulated by the Telephone Consumer Protection Act by calling at an inappropriate time. Tell them you will be filing a formal complaint with the Federal Communications Commission (FCC) or Federal Trade Commission (FTC) and hang up the phone.

Step 4 – File the formal complaint by either phoning the FCC or FTC, or by visiting their official websites.
